This is a legal agreement between you and China Top Herbal, Inc. This Agreement states the terms and conditions upon which China Top Herbal, Inc. offers its products and services. CAUTION: Acupuncture needles are restricted to use by qualified practitioners as determined by the state in which they reside. All acupuncture devices are sold to qualified practitioners only. The purchaser accepts full responsibility for the safe and proper use of these devices and agrees to indemnify and hold China Top Herbal Inc. harmless from any consumer claims against the ultimate use of these acupuncture devices. Extract Herbs : If you are ill, have any disease, are pregnant, or just improving your health, we are forced to warn you to go to a medical doctor. Because of the current lack of health freedom in America it is legal for them to kill you, but not legal for China Top Herbal Inc to help you to heal yourself. Upon entering our herbs section of our site, you hereby agree to take full responsibility for yourself, your health and release, indemnify and hold harmless China Top Herbal Inc. Any statements about the herbs we carry have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease. Moxa Products: Moxa should always be administered and used under the direction or supervision of a qualified practitioner. Do not leave patient unattended during any moxa use. Do not use moxa on the face, soft skin, or other sensitive body areas. Do not use moxa on infants or young children. Do not use moxa on patients who are not able to detect the sensations of heat or pain (i.e. elderly, patients with nerve damage, etc). When using moxa rolls, the burned ash must be frequently removed by gently tapping the side of the roll against a suitable container. For patient safety, do not use moxa rolls or any moxa product if damaged or cracked. Federal Law restricts TENS, EMS and Micro Current devices to only be sold to, used by, or used on the order of, a licensed physician. TERMS: SHIPPING; Do not use a P.O. box address. The shipping address must be a physical address. The customer pays the freight charges ($8.00 Minimum) by UPS. ORDERS RETURNED BECAUSE OF NON RECEIPT DUE TO ADDRESS ERROR OR NON-AVAILABILITY OF CUSTOMER ARE SUBJECT TO A RESHIP FEE OF $15.00 PLUS 50% OF ORIGINAL SHIPPING COST INCURED BY China Top Herbal. Special freight services required on heavy merchandise etc. Air delivery is available at actual shipping cost through UPS. Canadian and Non-Continental US Customers: Hawaii, Alaska, Puerto Rico and Canadian Customers: Please use a credit card or T/T wire transfer funds to our bank account. Shipping charges will be billed for the exact amount. We will ship as you specify. Payment: *WE ONLY ACCEPT PREPAID ORDERS* 1.) Credit card (Visa, Master card & Discover & American Express) orders will only be delivered to the billing address on file with the issuing bank. Also, we require the 3 digit CVV code on the signature strip of the card. All credit card information is verified before the order is processed for delivery. 2.) Sorry, no C.O.D available . Missing Merchandise At China Top Herbal Inc, we stand behind our products, as well as our service. Please examine your order carefully upon arrival. If you find an error was made, call Customer Service immediately and we will issue a Return Authorization number. All shipping discrepancies and damaged package claims will be honored when communicated to China Top Herbal Inc. within 5 working days from receipt. Report any missing items: 718-687-8000. Damaged Merchandise We take great care in filling, checking and packing your order. On rare occasions, a package may be damaged or lost in transit. The carrier is responsible for merchandise after it leaves our warehouse. For your protection, please follow these procedures: Carefully inspect each carton for damage. Check shipment against carrier's delivery receipt to make sure you received all cartons listed. Have the driver note shortages or damage, even if slight, on the delivery receipt. Immediately after delivery, open all cartons and inspect for concealed damage. If you find damage, DO NOT discard the carton or any contents of your package. Please contact China Top Herb Customer Service immediately at 1.718.687.8000. We will provide any assistance we can. Back Orders: If the item becomes back-ordered, we will notify you when the order is placed or you will be notified later with a telephone call. At that time you can decide to keep the item on back order, substitute for another item or cancel the item and make other arrangements.

Returns: Chinatopherbal will exchange or reimburse you for the cost of product ( freight not included) for any item returned within 30 days. There will be an applied restocking fee of 30% (Minimum $15) within 30 days. Title and risk of loss on such goods shall not pass to the customer until the expiration of the 30 day period. No returns will be accepted after 30 days. All returns must be in original factory condition, including all Packaging materials, warranty cards (that are not filled out), manuals, and accessories. We will not accept mistreated, opened, expired or used items for return. Please ship parcel back prepaid and insured then we will refund the full merchandise price excluding shipping costs unless the error was made by Chinatopherbal. If you have a problem or any questions about a product under warranty, please call us for further assistance. The following products cannot be returned: Discontinued Products Drop Shipped or Special Order Products shipped from the manufacturer, Expired Products Opened or Beauty Products, Creams and Liquid Products Shipping Instructions Insure the package, include copy of the invoice, and all information about why the item is being returned. Include the item number and the quantity that is being returned. Credit or Refunds A credit or refund may be applied to an account providing an item is returned to China top Herb in NEW condition. Refunds will be made upon receipt of the returned goods. Refunds will be in the form of a credit memo. If requested, refunds may also be issued by a company check. If the above procedures are not followed when returning items, a minimum 20% restocking fee may be charged. Drop Shipped or Special Orders Drop shipped means shipped straight from the manufacturer to our customer. Estimated delivery times may vary due to a variety of locations or quantity on hand. Drop shipped items may not be returned for any form of credit. Warranty: Chinatopherbal only provides a 30 day warranty on products.
